These terms cover the use of LSBid by buyers and sellers. By bidding you accept them, along with the individual seller's own auction terms, which are shown on every auction and lot.
LSBid is operated by Munger Vitality, Inc.. In these terms, "LSBid", "we" and "us" mean that company.
LSBid is a marketplace. Sellers list their own lots and are responsible for describing them accurately, for the goods themselves, and for handing them over. LSBid operates the platform, runs the bidding, and handles payment.
Everything is sold as-is, where-is, with no warranty of any kind, express or implied. Condition is conveyed through photographs and the seller's description. Inspection windows are offered so you can examine a lot before bidding, and you are responsible for satisfying yourself before you bid.
Winning a lot creates a binding agreement between you and the seller. If an invoice goes unpaid, the seller may charge the card you have on file for the balance.
Repeatedly failing to pay, or bidding without intending to pay, will end your ability to bid on LSBid.
Ownership of a lot, and the risk of loss or damage to it, pass to you when the invoice is paid in full — whether or not you have collected it yet.
Most lots are collected in person during the seller's published pickup window. Some lots can be shipped; the lot page says which. You choose collection or shipping once per auction, before your first bid, and you are told on the lot itself when a lot cannot be shipped.
Collect within the published window. A seller may set a grace period and a late-pickup fee, both shown in that auction's terms. A lot left uncollected past the seller's stated deadline may be treated as abandoned, and you remain liable for the invoice.
Report a lot from its page. Reports go to the seller, who is expected to respond. Because the seller owns the goods and the sale, refunds are at that seller's discretion, except where the law requires otherwise. LSBid does not refund from its own funds.
Where a lot is misdescribed, raise it with the seller through the report on the lot page rather than by charging back — a chargeback ends the conversation and can close your account.
If LSBid is unavailable while an auction is running, we may extend that auction's closing time so bidders are not shut out by an outage. Auctions that had already closed stay closed.
Keep your sign-in details to yourself; you are responsible for what happens under your account. We may suspend an account that abuses the platform, bids without intending to pay, or breaks these terms.
LSBid Account Verification is LSBid's only text message program. When you create an account, you agree to receive a one-time verification code by text message at the mobile number you enter. We send one message each time a code is requested, and never send marketing messages.

LSBid does not own, inspect, store, transport or guarantee any of the goods sold on it. Every lot belongs to the seller who listed it, and the sale is an agreement between you and that seller. LSBid operates the platform, runs the bidding and processes payment; it is not the buyer, the seller, or a party to the sale.
To the fullest extent the law allows, LSBid is not liable for the condition, safety, legality, description or value of any lot, nor for anything that happens during inspection, collection or shipping.
You agree to indemnify and hold harmless Munger Vitality, Inc., its officers and employees, from any claim, damage, loss or injury arising out of a transaction or auction conducted through LSBid, or out of your use of the platform.
These terms are governed by the laws of the State of North Dakota, without regard to its conflict-of-law rules. Any dispute with LSBid arising out of these terms or your use of the platform is subject to the exclusive jurisdiction of the state and federal courts located in North Dakota, and you consent to that jurisdiction and venue.
A dispute about a lot is between you and the seller of that lot; see If something is misrepresented above.
Each auction carries its own terms, set by that seller — pickup windows, removal deadlines, late fees and any lot-specific conditions. They are shown on the auction and on every lot, and they apply alongside these. Where a seller's terms are stricter, theirs govern that auction.
